The High Court decision of James Morgan Copinger-Symes v Maria-Christina Copinger-Symes & Anor [2024] EWFC 415 was published last week.
The applicant husband was represented by Richard Todd KC instructed by Hannah Sisk of Keystone Law. The respondent wife was represented by Justin Warshaw KC and Joshua Viney who were instructed by Helen Wilby and Emma Diack of Clarence Family Law. The intervenor was represented by chancery counsel.
This judgment considers the setting aside of a consent order for material non-disclosure and the question of setting aside gifts because of mistake or failure of basis.
The applicant and the intervenor have been given permission to appeal and the matter will be heard by the Court of Appeal later on in 2025.
